GENERAL CONTRACT TERMS
By using the web store located on the WWW.RED-LION.EU website and its sub-pages (hereinafter: Web Store), you accept the provisions of these General Terms and Conditions (hereinafter: GTC). If you do not wish to accept the provisions of these Terms and Conditions, you are not entitled to use the services provided by the Web Store. In this case, please contact them at any of our contact numbers.

1. Purchase process

Browsing in the Webstore does not require registration on the site, but you must provide your personal data during the purchase. You can find our data protection guidelines regarding the use of this site and purchases in our data protection policy at the following link: [https://red-lion.eu/adatkezelesi-tajekoztato-2/]

You can find a detailed description of the products in the Webshop by clicking on each product on the product data sheet. If you need more information, please feel free to contact our Customer Service.

If you want to buy, click on the “Buy” or “Add to cart” text on the specific product data sheet. You can then continue shopping by adding other products to the cart, or if you have finished shopping, click on the shopping cart icon at the top of the page.
Here you also have the option to change the quantity of the product, delete the product, and add new products to the cart by continuing the purchase.

To finalize the order, please click on the “Proceed to checkout” icon, on which page you can access the user’s account if you have already registered.

On the Shipping page, you can choose the shipping method that suits you, and in the case of a shipping address other than Hungary, you will also find the exact shipping cost here, which will be added to the total value of the products.

On the Invoicing and payment page, you have the option to enter a different billing address than the delivery address, and you can choose the payment method that suits you, which can be payment by bank card, bank transfer, or cash on delivery. Please note that for processing bank card payments, PayPal (Europe) S.á.r.l. et Cie, S.C. We use the cooperation of the financial service provider, which is a company completely independent from the Operator. When paying with a bank card, you accept the general terms and conditions and data protection policy of this service provider, which you can find more information about at www.paypal.com. We would like to inform you that your bank card and other financial data will not be transferred to the Operator. All payments initiated via PayPal are encrypted to ensure the security of your information.
If you choose the payment method by bank transfer, please initiate your transfer order to the beneficiary listed in the confirmation within 8 days of the purchase, otherwise the Operator reserves the right to cancel the purchase.

If you would like to receive an electronic newsletter about our products, current promotions and other offers in the future, please check the subscription box at the bottom of the page. Our newsletter service is free and can be canceled at any time, without any purchase obligation.

On the last page, you have the opportunity to review the products selected during the purchase, their prices, delivery and payment terms, as well as the data required for fulfillment, as well as the total amount to be paid by you. If you want to change any data, you can do so by clicking on the appropriate link.

If the entered data is correct, you can finalize your order by clicking the “Order” button. Placing an order is considered an offer to the Operator and creates a contractual obligation with it.

The prices indicated in the Webshop are in forints and include the current general sales tax, but do not include other additional costs (e.g. packaging, shipping), which will be indicated during the finalization of the purchase.

The contract concluded with the Web Store is created in Hungarian, which is stored by the Operator in electronic form.

2. Binding offer, creation of contract, performance

After sending the order, our system will confirm your order in an automatic email within 48 hours, where you can view the main details of the purchase again. If you notice an error, please contact us as soon as possible via one of our contact numbers. If you do not receive the email confirmation within the above deadline, your offer will no longer be binding. If you really do not wish to make use of the purchase option, please inform our customer service.

The automatic notification sent by us does not in itself mean the beginning of the fulfillment of the purchase and is not legally binding for the Operator. The Operator reserves the right to limit or refuse the delivery of individual products depending on the stock, but at the same time we always strive to fulfill the order in full.

By placing an order placed in the Web Store and its acceptance by the Operator, a sales contract is created between the parties as absentees, which is considered concluded in writing. The legal relationship between the parties is governed by Hungarian law, primarily by Act CVIII of 2001 on certain issues of electronic commercial services and services related to the information society. Act, Act V of 2013 on the Civil Code, Government Decree 45/2014 (II.26) on the detailed rules of contracts between consumers and businesses, and Act CXII of 2011 on the right to self-determination of information and freedom of information , and Regulation 2016/679/EU on the protection of natural persons with regard to the processing of personal data and on the free flow of such data, as well as on the repeal of Regulation 95/46/EC.

In order to avoid possible misunderstandings later, we ask that if you experience damage to either the package or the product itself during the delivery of the product, please notify the person carrying out the delivery as well as our customer service as soon as possible. In the event of damage, you have the right to refuse delivery.

Please note that regardless of the payment method, the Operator retains ownership of the product until full payment of the consideration, on the basis of which you are not entitled to dispose of the product as your own until payment is made.

Your satisfaction is our primary goal, and we will do everything we can to achieve this. If you have any comments, please contact our customer service so that we can help you.

3. Right of withdrawal

If you place your order as a consumer, you have the right to cancel without giving a reason until the time of receipt of the products and for 14 days thereafter. In relation to the contract between the parties, a natural person acting outside the scope of his profession, independent occupation or business activity is considered a consumer.
If you receive your order at several different times, the withdrawal period is calculated from the receipt of the last product.

If you wish to exercise your right of withdrawal, please send your declaration to our customer service in a verifiable manner no later than the 14th day. In order to make administration easier, you will find the cancellation declaration required for cancellation on our website.

Failure to comply with the deadline for withdrawal results in the loss of rights.

If you exercised your right of withdrawal with respect to individual products or the entire order, you must return the product you do not wish to purchase to our customer service immediately, but within 14 days at the latest. Please note that we are unable to accept parcels returned by cash on delivery. In case of cancellation, please return the product to us in its original packaging, for which our customer service will assist you if required.

In the event of cancellation, the Operator will refund you the full amount paid as consideration, including the costs incurred in connection with the performance, within 14 days of becoming aware of the cancellation, but no sooner than after the product has been returned without doubt. In case of personal return, the Operator will immediately refund the fee in cash. During the exercise of the right of withdrawal, you will not be charged any other fees or deductions beyond the cost of the return, not including the decrease in quantity of the product, or the decrease in value resulting from its unusual or improper use.
In the absence of a different agreement between the parties, the amount due to you will be refunded in the same way as the payment method used during the order. Based on your express consent, we may use another payment method for the refund, but you will not be charged any additional fees as a result. Please note that if you specifically chose a shipping method other than the least expensive standard shipping method during your order, we are not obligated to refund the resulting additional cost.
You may not exercise the right of withdrawal
– in the case of a contract for the provision of services, after the completion of the service as a whole, if the Operator began the performance with the express, prior consent of the consumer, and the consumer acknowledged that he loses his right to cancel after the completion of the service as a whole;
– with regard to a product or service whose price or fee depends on the possible fluctuation of the money market, which cannot be influenced by the Operator, even during the 14-day withdrawal period;
– with regard to perishable products or products that retain their quality for a short time (for example, certain foods, cosmetics);
– with regard to a product with closed packaging that cannot be returned after opening for health protection or hygiene reasons (e.g. cosmetics);
– with regard to a product which, due to its nature, is inseparably mixed with another product after delivery;

4. Warranty, guarantee, complaint

The products in the Webshop can be used within the expiration date indicated on the packaging or on the product, after which their use is strictly prohibited. The operator undertakes that the warranty period has not yet expired at the time of delivery, but is not burdened with any other obligations beyond this.

Please report your warranty claim to our customer service immediately after detecting the problem, we will do everything we can to remedy it. A person who is considered a consumer may exercise his warranty claim within a maximum period of 2 years after receipt, otherwise the limitation period is 1 year. This provision does not apply to goods that deteriorate in a shorter time (for example: Schüssler salts).

In the framework of a warranty claim, you can primarily request repair or replacement, in the event of failure to do so or the Operator’s legal refusal (impossibility or the occurrence of significant additional costs), you can instead request a fair price reduction, or you can have the defect repaired at the Operator’s expense, and ultimately within the 14-day withdrawal period detailed previously it can withstand too much. Please note that cancellation due to an insignificant error is only possible within the 14-day period. In addition to bearing the costs, you have the right to transfer your chosen accessories warranty.

It is sufficient for you to inform us of the defective performance within 6 months of receiving the product, but after that you must prove that the indicated defect already existed at the time of receipt.

We would like to inform you that there are currently no products in the Webstore that are subject to the mandatory warranty for certain consumer durables. (IX. 22.) Government decree would apply.

If you wish to file a complaint with us, you can do so through our customer service or through the competent authorities. We try to investigate all complaints as soon as possible, but within 30 days at most, and provide a meaningful response. In the absence of this, or if our answer is not acceptable to you, you have the option of contacting the appropriate authorities. If you wish to record your complaint with us, please contact our Customer Service directly.

Regional offices are primarily responsible for consumer protection matters.

5. Data protection

Regarding our data protection guidelines, please read the information contained in the Data Protection Information.

6. Miscellaneous Provisions

The operator is not the manufacturer of the products distributed in the Webshop, but only the seller. The products are partially or fully considered food supplements, they are not suitable for diagnosing, treating or curing any disease, taking them does not guarantee the avoidance of any disease. We recommend that you consult your doctor before using them. For dosage and use, please read the label.

The photos on the website are illustrations and may differ from reality.

The operator reserves the right to amend these GTC at all times, excluding orders already in progress, in which case the GTC provisions that were in force at the time of placing the order shall govern. Neither the affected parties nor the visitors or users will be notified of the change separately. The current General Terms and Conditions are always available at https://www.red-lion.eu/.

These GTC are effective from August 16, 2024.
